Shift pay is legal. However, it it a small way of ripping you off. The problem with shift pay is ostensibly “What happens when I work overtime?“ The law does not specifically prohibit the employee from being paid a partial amount of “shift pay”, yet try and collect your “overtime”. If I were the employee in this situation, I would monitor my hours worked very closely, and if my total number of hours worked equated with a half or third, or quarter of a shift, I would ask for that amount of time in my pay.
